GORDON L. GERSON

Gordon L. Gerson emphasizes both real estate financing and real estate transactions, as well as creditor rights litigation in his practice. Mr. Gerson has also worked closely with large financial institutions, life insurance companies, publicly-held companies, private companies, developers and individuals in financing transactions.

Mr. Gerson has an excellent reputation in real estate and real estate financing transactions. Individual transactions include credit facilities up to $125,000,000 involving all character of real property, including industrial, office, commercial and retail, hotel/motel, and land. His real estate practice includes the United States and Mexico. He is actively involved in serving the conduit lending and special servicing industries, and represents major national clients in these areas on a volume basis. He is a frequent writer and speaker on both trends in the mortgage banking industry, as well as technical issues confronting both lawyers and non-lawyers in the lending industry. He also represents national tenants and developers of major shopping center developments.

Mr. Gerson has extensive experience in state court receivership actions, unlawful detainer proceedings, and other collection proceedings, and the Firm also handles these matters on a volume basis for institutional and non-institutional clients. He has personally handled more than one hundred commercial evictions for shopping center owners or owners of industrial property, more than fifty (50) receivership actions for income-producing real property secured by loans of more than $1,000,000, and numerous other collection proceedings. Additionally, from 1994 to 1996 he was actively engaged in representing purchasers of large loan portfolios of HomeFed Bank, Western Federal and Glendale Federal, among others. During that time period, he was engaged in every aspect of disposition of loans and assets ranging from $500,000 to $15,000,000.

Mr. Gerson also has extensive experience representing creditors in bankruptcy actions. He has filed relief of stay actions to foreclose on real property on both a volume basis for some lenders, as well as an individual basis for others since 1980. He has also defended creditors in preference litigation and represented creditors facing cram down plans of reorganization.

He has also represented mortgage companies, commercial shopping center owners, apartment complex owners, and national tenants companies of all sizes, as well as individuals.

From June 1992 to March 1994, Mr. Gerson was a board member of Pioneer Liquidating Corporation where he made policy regarding liquidating a mixed asset portfolio of $200,000,000 of hotel, office, commercial and residential loans and REO.

Mr. Gerson received his Bachelor's Degree from the University of California, Berkeley, in 1973 with honors and distinction. He received his law degree from the University of San Diego School of Law in 1976. He was admitted to the State Bar of California and Ninth Federal District in 1976. He is a member of the State Bar of California, San Diego County Bar Association, San Diego Bankruptcy Forum, California Bankruptcy Forum, San Diego Receivership Forum, California Receivership Forum, Commercial Section of the San Diego County Bar Association, Bankruptcy Section of the San Diego County Bar Association, Real Property Section of the San Diego County Bar Association and Real Estate Section of California State Bar, Mortgage Bankers Association, Commercial Mortgage Securities Association, American Land Title Association. Mr. Gerson is a native of San Diego County and has practiced law in San Diego for over 28 years, where he is intimately familiar with San Diego's legal and financial community.
